What Is a Notice of Claim?

Notice of Claim is a formal written communication that tells a potential defendant or responsible agency about an injury claim. It usually identifies the event, the injured person, the claimed harm, and the basis for responsibility. A notice may support later legal action, but it is not the same as filing a lawsuit.

Key Takeaways About Notice of Claim

  • A notice is a claim communication, not a lawsuit.
  • The recipient may depend on who operated or controlled the bus.
  • A notice may have different rules from an insurance demand.

How Notice of Claim Works

A Notice of Claim gives a potential defendant or responsible agency information about an injury and the event that caused it. The document may describe the bus route or vehicle, the crash location, the injuries, and the conduct believed to have caused harm. The recipient can vary when a public transit agency, private carrier, driver, or another party may share responsibility.

Notice requirements depend on the parties and the type of claim. A notice may be directed to an agency office or another designated recipient, while an insurance demand usually goes to an insurer during settlement discussions. A notice also does not replace preserving medical records, incident reports, witness information, and other evidence related to the bus accident.

From the Atlanta Auto Law team

When we handle a bus accident claim, we identify each potentially responsible party and check where the notice should go. We also compare the notice details with medical records, crash information, and available witness accounts. Our team treats the notice as one part of the claim record, not as a substitute for the lawsuit or settlement process.

Notice of Claim in Practice: A Real-World Example

A passenger is injured when a city bus collides with another vehicle in Atlanta. The passenger's attorney prepares a Notice of Claim describing the crash, the bus operator, the injuries, and the facts supporting responsibility, then reviews the proper recipient before sending it.
