What Is an Independent Medical Exam?

An Independent Medical Exam is a medical evaluation requested during a legal claim to assess an injury, diagnosis, treatment, or related limitation. A doctor who is not the treating provider conducts the examination and prepares findings for the requesting party. The exam does not create a doctor-patient treatment relationship.

How Independent Medical Exam Works

Independent Medical Exam usually begins when an insurer or opposing party asks for an evaluation related to a claim. The examiner reviews selected medical records, asks about the accident and symptoms, and conducts an examination within the appointment’s stated scope. The doctor then prepares a report that addresses the medical questions presented.

The report may discuss whether the claimed condition has a relationship to the accident, whether the reported limitations match the clinical findings, and whether further evaluation appears relevant. The examiner does not manage treatment or replace the patient’s own physicians. In a brain injury claim, the review may address reported changes in memory, concentration, communication, or daily activities. Medical Records and an Expert Witness may also affect how the findings are understood in the claim.

From the Atlanta Auto Law team

When we review an Independent Medical Exam, we compare the report with the client’s medical records, symptom history, and account of the accident. We also check whether the examiner addressed the questions asked and whether the conclusions fit the documented traumatic brain injury. Those details help us identify issues for negotiation or litigation.

Independent Medical Exam in Practice: A Real-World Example

A driver reports headaches, memory problems, and difficulty concentrating after a collision. An Independent Medical Exam reviews the reported symptoms and medical history, then gives the insurer an outside assessment of the claimed traumatic brain injury.
